Early Neutral Evaluations (“ENEs”) in children and finance cases allow parties to settle with the assistance of an experienced specialist barrister appointed jointly as an evaluator, who will give their opinion on the merits and weaknesses of your case. The evaluator will guide parties toward a settlement.
ENEs are usually carried out at an early stage of a case. The evaluator will produce an objective evaluation of the case based on an agreed set of facts and documents both parties wish to submit. This assessment can be delivered through a report or meeting with you. It is important to remember that while the assessment is not binding, if both parties agree with the evaluation, your litigation can consensually end on terms that both parties wish to accept.
