Arbitration delivers timely, cost-effective, private and confidential resolution as a binding alternative to using the court process. It is a form of private dispute resolution where a specialist arbitrator (a private judge) is appointed to resolve a dispute as a binding alternative to using the normal court process. It can cover both financial claims and appropriate private children disputes. The parties must agree to enter the process, but once the decision is made it has the same effect as if it were a decision of the court.
Arbitration can be used at any stage of a dispute and can be used for discrete issues or interim decisions, as well as final decisions. The process is flexible and can be tailored to the needs and wishes of those involved and their legal advisors. It is ideal for people who want to resolve a family dispute without the huge delay and ongoing expense associated with a drawn-out court process.
As well as representing clients in arbitrations, senior barristers at 4PB, many of whom are also part-time judges, can be appointed as arbitrators to decide financial claims and children disputes. For more information on family law arbitration, and how to appoint an arbitrator, see the website of the Institute of Family Law Arbitrators (IFLA).
