4pb’s Court of Protection team draws on our recognised strengths and wide-ranging knowledge in other disciplines such as public, international, immigration and human rights law to provide a comprehensive and focused service.
We provide advice and representation on all aspects of health, social care and financial decision-making. We represent local authorities, NHS trusts, statutory bodies, clinical commissioning groups, family members and protected parties through the Official Solicitor or accredited legal representatives in cases that cover a wide range of legal, factual and welfare issues including:
- Residence and contact disputes
- Complex issues about a person’s capacity to make decisions in their family and personal relationships
- Deputyship applications arising from both welfare and financial disputes within the family
- Advisory work on financial and welfare issues for public bodies
- Medical treatment decisions concerning those who lack capacity, or those brought under the inherent jurisdiction for adults who have capacity but are vulnerable
- Social care cases with a human rights element
