Having rightly refused a mother’s application to relocate with her two children to Ukraine as it would be contrary to the children’s best interests, a judge had erred in granting temporary permission for the children to remain in the Ukraine for a further month. That decision was inconsistent with his findings as to the mother’s conduct and failed to take account of the risk of the children’s retention, particularly since any incentive for the mother to obey a return order had been removed by the adverse decision against her.
