Re J (A Child: Brussels II Revised: Article 15: Practice & Procedure) sub nom London Borough Council of Islington v R & Ors

29th October 2014

Court

Family Court

Practice Areas

Public Children Law

When dealing with care proceedings with a potential jurisdictional issue, the court had to decide, as a matter of priority and during the initial stages of the proceedings, whether to make a transfer request under Regulation 2201/2003 art.15. The court was not to abrogate its art.15 decision-making responsibility to the court or central authority of another Member State, and judges were to co-operate closely in order to ensure that art.15 cases were dealt with at the most appropriate judicial level.
