Diplomatic Immunity and Care Proceedings to be considered by the Divisional Court.

Prof Jo Delahunty, Chris Barnes, and Lucy Logan Green, along with Prof Antonios Tzanakopoulos, Associate Professor of International Law, University of Oxford Faculty of Law and Fellow in Law, St Anne’s College, are appearing before the Divisional Court, on 2nd and 3rd March 2021, in a case considering an application for a declaration of incompatibility concerning the immunity provisions of the Diplomatic Privileges Act 1964 which implements the Vienna Convention on Diplomatic Relations.

 

The hearing, before the President of the Family Division and Sir Duncan Ouseley, arises in proceedings which have previously been reported considering the impact of diplomatic immunity in the context of applications under Part IV of the Children Act 1989 (see A Local Authority v AG [2020] EWFC 18 and A Local Authority v AG (No. 2) [2020] EWHC 1346 (Fam)).

Jo, Chris, and Lucy act on the instructions of Deborah Marsden, of Creighton & Partners Solicitors, and represent the child who participates in proceedings in her own right as the 2nd respondent.
