X (Discharge of Care Order)

26th June 2015

Chris Barnes acted for the Mother in an application for discharge of a Care Order and of a Section 34(4) order permitting the refusal of contact which considered  the impact of the Local Authority’s failure to implement key aspects of its care plan and where the Independent Reviewing Officer was found to have “failed to bring independent, robust and effective overview of the Local Authority management of the care plan”.

The Section 34(4) order was discharged and the Mother’s application for discharge of the Care Order was adjourned to allow further assessment and for the Local Authority to address its failure to provide details of available support services.
