On application from the High Court, Cliona Papazian appeared on behalf of the Respondent. Moylan LJ concluded that the judge at first instance had failed to give sufficient consideration to the Mother’s application that the court should protect the children under the parens patriae jurisdiction. Her application was remitted to another judge of the Family Division to determine whether the circumstances were sufficiently compelling to require or make it necessary that the court should exercise its protective jurisdiction.
