This is the mother’s application for permission to appeal. The mother sought to adduce further expert evidence on whether low Vitamin D levels heightened infant’s vulnerability to bone fractures. She argued the judge failed to give this sufficient weight.

Refusing permission, Thorpe LJ deemed that the expert evidence at trial was detailed and disregarded Vitamin D deficiency as a cause of the fractures. The strength of this evidence ensured the trial judge rightly did not deal with it in his judgment.
