Certain material deployed in a judicial review of the imposition of a terrorism, prevention and investigation measure on an individual was ordered to be disclosed for use in family proceedings concerning his children. However, it was not safe to assume that the Home Secretary would have made the same assessment about what sensitive material to disclose in the judicial review proceedings if he had known that it might be further disclosed in family proceedings, so disclosure was refused in respect of the secretary of state’s open material deployed in the judicial review.
