Notwithstanding the purpose and policy of the Hague Convention on the Civil Aspects of International Child Abduction 1980, the instant case was a rare example in which the court had to divert from the normal process of returning children. The judge had been entitled to set aside return orders for the return of three children to Hungary, the country of habitual residence, on the basis of medical evidence of the eldest child’s mental state and the consequence of separation of the siblings from their mother.
