A local authority had acted lawfully in determining that a child whose grandmother had voluntarily undertaken to care for him when his mother was arrested was not a child in need who required accommodation pursuant to the Children Act 1989 s.20(1). The mother and grandmother had entered into a private arrangement for the care of the child, and the local authority had played no part in facilitating that arrangement.
