In this review of recent cases in the area of public law, I will consider cases that deal with the following issues:

  • the court’s duty to remain fully engaged in the fact-finding process,
  • the correct approach to fact-finding issues at the interim stage,
  • the jurisdiction to make injunctions protecting a foster placement pending final decisions, and
  • whether a court should hear oral evidence on an interim application to separate a young child from the parent.
