Henry Setright QC and Jonathan Evans represented a Respondent Mother in successfully resisting an order for the child’s summary return to Poland and established defences under Article 13(b) and child’s objections. The Court was not satisfied that on the facts of the case, the protective measures available in Poland could effectively or adequately protect the child from a grave risk of harm. This was the re-hearing from the case of Re C [2021] EWCA Civ 1354. Christopher Hames QC represented the Applicant Father.
