An application under the European Convention on Recognition and Enforcement of Decisions concerning Custody of Children and on Restoration of Custody of Children 1980 was refused on the grounds of art.10(1)(a) and art.10(1)(b) where a custody order made by the Turkish court was based on mistaken evidence that the children had been left in England by their mother while she returned to live in Turkey. In fact she was living with them in England and it would be contrary to the children’s welfare to return them to their father in Turkey.
