Reported Case: Six members of Chambers appear in M v F (Art 13 Threshold Not Met) [2025] EWHC 2629 (Fam)

Mr Justice MacDonald handed down judgment in M v F (Art 13 Threshold Not Met) [2025] EWHC 2629 (Fam), in which 5 members of chambers appeared.

The case concerned two children who had been abducted from Saudi Arabia, to Yemen, then Brazil and finally, England. The paternal grand-mother then applied for asylum for herself and the children, and the children spent over 1 year in an asylum hotel.  The children had been separated from the mother (who had a Saudi Arabian custody order in her favour) for over 2 years. Mr Justice MacDonald placed the children in the applicant mother’s care on day 1 of the trial, pursuant to s.5 of Child Abduction and Custody Act 1985.  Mr Justice MacDonald went on to determine that none of the defences were established the respondents and ordered a summary return of the children in their mother’s care to Brazil.
