Reported Case: Frankie Shama Successfully Represented the Applicant Mother in G v L (Return Order) [2025] EWHC 3340 (Fam)

Frankie Shama, instructed by Ron Gilfillan of Oliver Fisher Solicitors, successfully represented the Applicant Mother in securing the summary return of her child to Italy in the case of G v L (Return Order) [2025] EWHC 3340 (Fam) before Mr Justice MacDonald.

The court considered the application of Article 13(b) and whether the child objected to a return. Mr Justice MacDonald concluded the Respondent Father had attempted to engineer a relocation “by the back door” (paragraph 75) and emphasised the exceptions to return in Article 13 are narrow ‘exceptions’ to the ordinary consequences of wrongful removal/ retention, rather than ‘defences’ that act to exonerate a parent’s wrongful conduct (paragraph 32).
