Reported Case: 5 Members of 4PB appear in R (Children: Setting Aside Hague Return Order) [2025] EWCA Civ 1426

The Court of Appeal has handed down its judgment in R (Children: Setting Aside Hague Return Order) [2025] EWCA Civ 1426, in which five members of 4PB appeared.

The matter concerns an appeal filed by the children, through their litigation friend, against the decision of the President of the Family Division. The appeal challenges the dismissal of their application to set aside a return order to the USA made on 5 November 2024.

The Court of Appeal allowed the children’s appeal, setting aside the President’s dismissal of their application. The return order was also stayed pending further order of the Court.
