Ralph Marnham instructed by Christina Pippas and Laura Burrows of Collyer Bristow acted for the applicants and Mai-Ling Savage instructed by Hilka Hollmann of Dawson Cornwell acted for the Guardian in the recently reported decision of Re H (Anonymous Surrogacy)[2025] EWFC 366.
The case concerned an application for a parental order following a surrogacy arrangement in Nigeria which used an anonymous surrogate. Although the court ultimately granted the application, Theis J repeated the President’s warning in Re H (Anonymous Surrogacy) [2025] EWHC 220 to intended parents who choose an anonymous surrogacy process and noted that there may come a time when the approach in determining whether a surrogate cannot be found will need to be reconsidered, as set out by Knowles J in Re QR (Parental Order: Dispensing with Consent: Proportionality) [2023] EWHC 3196.
