4PB finance team recent reported cases

The finance team at 4PB has been involved in a number of reported decisions in the last couple of months.

Charles Hale QC and Henry Clayton acted for the wife in AA v BB [2014] EWHC 4210 (Fam), in which Moylan J considered a complex multi-jurisdictional procedural history, Articles 12 and 13 of Council regulation No 4/2009 (the Maintenance Regulation) and the law on setting aside the grant of leave. The court found that it did have jurisdiction to determine the wife’s claims, and the husband’s application to set aside the grant of leave was refused. Charles and Henry were instructed by Healys LLP.

Rex Howling QC acted for the wife in Mann v Mann [2014] EWCA Civ 1674 in an appeal brought by the husband concerning the question of whether the court had jurisdiction to order him to make payments to the wife prior to the determination of her enforcement proceedings. Rex was instructed by direct access.

Stephen Lyon represented the husband in SS v NS (Spousal Maintenance) [2014] EWHC 4183 (Fam), where the case was allocated to be heard in the High Court because of the nature of the wife’s income claim, and the assets were 3.3 million. Stephen was instructed by SBP Law.

Stephen Lyon also represented the appellant husband in B v B [2014] EWHC 4545 (Fam), where the husband was challenging an award made to the wife which took into account various aspects of his discretionary employment bonus as income. He was successful in his appeal against the order made for the periodical payments made to the wife, and the wife’s cross appeal was dismissed. Stephen was instructed by SBP Law.

Nicholas Fairbank acted for the intervener in the case of Arif v Anwar [2015] EWHC 124 (Fam) which involves a bankruptcy and an application for a financial order on divorce. Nicholas was instructed by Saints Solicitors.
