Christopher Hames, Dorothea Gartland & Ruth Kirby all appeared for the sucessful appellants in Re M 2015 [EWCA] Civ 206.
This important case alters the approach to be taken on issues of child’s objections in Hague Convention proceedings. The “Re T” test no longer to be followed. It also provides important guidance on how children should be joined to proceedings in the Court of Appeal when they were not parties at the first instance.
